Delaware County DUI Lawyer Defending Your Rights Kevin Marciano
Getting arrested on a DUI charge is stressful. You’re probably worried about the consequences of conviction. Fines and fees add up quickly. A license suspension would limit your freedom. Our defense attorneys fight to minimize penalties, or eliminate them entirely, in Delaware County every day.
Most people who are arrested for a DUI in Pennsylvania believe that they only have one legal option: pleading guilty to the charges and accepting the associated penalties. But the truth is that other legal options often exist after a DUI arrest which can result in a much more favorable outcome for you. The main objective of our Delaware County DUI defense lawyer is to minimize the negative consequences of your DUI arrest by negotiating with prosecutors or challenging your arrest. We have helped many clients in the past just like you by negotiating favorable plea bargains, reducing their penalties and even helping them to become acquitted of the charges altogether.
Challenging A DUI Arrest In PA
In addition to a negotiating a favorable plea bargain for you, our experienced DUI defense attorneys may be able to help you challenge your arrest. Law enforcement officers frequently make crucial mistakes during a DUI arrest which can render certain evidence against you to be inadmissible:
Did the officer have reasonable suspicion to stop your vehicle?
Were you read your Miranda Rights or warned about PA’s Implied Consent law?
Was the breath test administered correctly?
These are just a few potential grounds on which a DUI arrest can be challenged. But while it is possible to achieve a favorable outcome after a DUI arrest, you will need to work with a highly qualified DUI defense lawyer.
Selecting A DUI Defense Attorney
The attorney that you choose to represent you can have a major impact on your overall success when challenging a DUI arrest. You need someone with extensive experience in defending individuals accused of drunk driving in Pennsylvania and who is willing to fight aggressively on your behalf.

Recently, police made four felony drunk driving arrests during a five-day stint in Kent County. One of the arrests was for a seventh alleged offense. The arrest was made in Harrington after Delaware State Police were checking on what looked like an expired temporary registration. Further investigation led to the police smelling alcohol inside the car. The driver of the vehicle was taken into custody following standardized field sobriety tests and a portable breath alcohol test. The other arrests were for three men facing their third DUI charges each. Some of the men had their licenses revoked or suspended.
July 21st, 2016 – Ignition Lock Law Could Now Be Applied To 1st Time DUI Drivers
The Senate and The House both passed a bill in May of 2016 which would allow those convicted of a first time DUI offense to use an ignition interlock device on their vehicle instead of having a suspended license. This device forces the driver to blow into a tube before the car will start. If there is an unacceptable amount of alcohol in their system, the lock will prevent the car from starting.
